Chino Cannabis Grow Busted: Compliance Wins with Stayed Receiver

Unpermitted cannabis grow & 38 violations cleared through cooperation with property owner—Chino property now safe & compliant.

In a quiet Chino neighborhood lay an incognito cannabis cultivation with uninhabitable conditions. On the exterior, 38 unsafe and unattractive violations of abandoned vehicles, extensive animal urine and feces, junk, trash, debris, overgrown vegetation and several dangerous, unpermitted structures. Inside were over 470 cannabis plants and continued unpermitted construction, specifically for cultivation.

Before

The City red-tagged the property as uninhabitable and notified the owners to repair or remove the extensive substandard conditions of the residence within a timely manner. Civica Law worked with the property owner, who agreed to sell it to buyer who became responsible for remediating the property.

The City initiated litigation to bring the property into full compliance. The property owner and buyer agreed to appoint a court receiver with stayed powers over the property while the buyer removed all code violations.  As part of this agreement, the City received full cost recovery for its enforcement efforts from the property’s escrow.

After

A court-appointed receiver with stayed powers, a.k.a. stayed receiver, in code enforcement cases like this gives the City reassurance that court-appointed oversight over the new owner’s rehabilitation or removal of the violations. while keeping costs down. This Chino residence is a successful result of the City working cooperatively with a new responsible buyer. The new buyer demolished all buildings and outdoor violations from the property and is again safe for surrounding homes.
